How David prevented a client from losing a home because of a greedy broker
After we had a new child, my wife and I decided to sell our house in New Jersey and buy a house with an extra bedroom and an extra bathroom. We were upgrading and needed extra space. David was our attorney.
We had multiple buyers at first, but the buyer we chose was a tough negotiator. After the inspection he wanted major repairs, like a new roof (even though it was a perfectly fine roof, it was not leaking or anything). The buyer wanted us to pay for a new chimney, and it is a structural thing. He made claims about things he discovered during inspection, but they were not true. David actually made the buyer admit that he never did an inspection of the roof.
The buyer knew that he could put extra pressure on us because I had to buy this other house and time was an issue. He was deliberately pushing the date of the closing so that I would agree to his terms.
We found a nice four bedroom house for ourselves and signed a contract, willing to buy it using the money we made selling the old house.
But the seller received a last minute bid (it was slightly higher) and tried to back off from our contract. The broker of the seller had a relationship with this new alternative buyer and would probably get more money from that person. But the contract David put together for us buying the house was air-tight, they could not back off. We also needed the seller to do some repairs done in our new home. Some small things like appliances and exhaust fans were not working.
There was a mortgage as well.
It was a matter of getting to the closing on time with both houses. It was double pressure, lots of moving parts. David was an essential part of the whole process from the bidding to the closing.
He put pressure on the folks to get things moving quicker. There’s no way we could have done this without such a competent lawyer.
